Yes, video depositions are admissible in both state and federal courts when properly noticed and recorded in accordance with the applicable rules of civil procedure. For federal cases, Rule 30(b)(3) and Rule 32 of the Federal Rules of Civil Procedure govern the use and admissibility of depositions, including video. The recording must be made under oath, with proper notice to all parties, and handled by a qualified, impartial operator — such as a certified legal videographer.


A video deposition offers significant advantages over a written transcript alone:

  • Visual Credibility: Jurors and judges can see facial expressions, body language, tone, and hesitation — all of which can affect credibility.
  • Impeachment Power: Playing back a prior inconsistent statement is far more powerful on video than reading it from a page.
  • Nonverbal Cues: Pauses, sarcasm, evasive answers, or visible discomfort can be lost in text but captured clearly on camera.
  • Trial Prep: Attorneys often use video to prepare for trial, evaluate witnesses, and develop case themes.
  • Remote Participation: Video clips can be presented at trial even if the witness is unavailable.


To record a deposition by video, the deposition notice must:

  • State that the deposition will be audio-visually recorded.
  • Include the name and address of the legal videographer or videography company, if required by local rule.
  • Provide proper advance notice to all parties (typically under Rule 30(b)(3) or state equivalents).
    LexHD works with law firms to ensure every deposition is noticed correctly, helping avoid procedural objections to admissibility.


The deposition must be recorded by a neutral, qualified operator — often a Certified Legal Video Specialist (CLVS) trained by the National Court Reporters Association (NCRA) or an equivalent state-certified videographer. Yes. Under Federal Rule 32(a)(4) and most state equivalents, video deposition footage can be played in court if:
